Compliance Charter & SLA

Terms & Conditions

These Terms & Conditions govern the provision of premium housekeeping, executive security, and specialized manpower outsourcing services by Recrutiz Staffing Solutions Pvt. Ltd. (hereinafter referred to as "the Company") to the engaging party (hereinafter referred to as "the Client").

ISO 9001:2015 & PSARA Vetted Operations

All manpower deployments and services listed herein are processed under strict compliance with the Private Security Agencies Regulation Act (PSARA) and registered national labor framework policies.

Section 01

Scope of Services

The Company shall provide vetted manpower, facility management, and integrated deployment services as designated under the mutually agreed Service Level Agreement (SLA). The specific responsibilities of deployed staff, daily rosters, duty charts, and work protocols will be outlined clearly in writing.

Any expansion of service scopes, additional guard mandates, or auxiliary housekeeping requirements requested by the Client shall be structured as written addendums to the primary SLA, subject to mutual pricing agreements.

Section 02

Deployment & Replacement

All personnel deployed to the Client premises undergo extensive background validation, identity verification, and police clearance verification (in complete alignment with PSARA regulations). Recrutiz guarantees the fitness, professional qualification, and grooming of all deployed professionals.

We are fully committed to resolving staffing contingencies seamlessly:

  • Contingency Replacements: In cases of sudden staff absenteeism, illness, or performance mismatch, the Company will source a competent replacement within a standard, prompt timeframe (aiming for 4 hours).
  • Immediate Replacements: Escalated replacements are subject to location constraints, specialized skill requirements, and active local personnel reserves.
Section 03

Working Hours & Shifts

Standard working hours for deployed personnel are structured around 8 to 9 hours per day (inclusive of designated rest intervals) in strict alignment with regional labor guidelines. Staff rotation, rest periods, weekly offs, and shifts will be managed systematically by our HR operations team.

Any overtime hours requested by the Client's facilities manager to meet special operations, emergency coverage, or public events must be documented in the attendance register and will be billed at applicable overtime rates in compliance with state-specific Minimum Wages Acts.

Section 04

Payment Terms

Invoices will be compiled and raised by the Company on a monthly basis, detailing the actual shifts worked, statutory contributions, and direct service rates. The Client agrees to process payments in full within **7 to 15 calendar days** from the invoice receipt date.

In cases of chronic payment delay, the Company reserves the right to charge an interest penalty of 1.5% per month on outstanding balances or, following a formal 5-day written alert, place active field services on hold. Rates are structured to guarantee transparent compliance with all national payroll minimums.

Section 05

Statutory Compliance

The Company assumes absolute legal responsibility for statutory payments, labor insurances, and central regulations. We guarantee strict, monthly contributions toward:

  • EPF: Employee Provident Fund contributions strictly submitted under EPFO guidelines.
  • ESIC: Employee State Insurance contributions ensuring absolute medical safety for field personnel.
  • Minimum Wages Act: Absolute compliance with central and state minimum labor wage tariffs.
  • Compliance Audits: Certified government Challans, ECR receipt sheets, and compliance documents are shared transparently with the Client's legal team every month upon written request.
Section 06

Client Responsibilities

To ensure a highly professional and safe operational layout, the Client shall:

  • Provide a secure, hazard-free workplace environment in compliance with national POSH and safety laws.
  • Ensure access to essential basic facilities, including hygienic sanitation facilities, sheltered guard cabins, and fresh drinking water.
  • Review, verify, and approve staff attendance registries promptly to avoid billing delay.
  • Non-Solicitation: Refrain from negotiating individual wages directly with deployed staff or soliciting/hiring them directly during the contract term and for 12 months after its conclusion.
Section 07

Staff Management

All deployed security officers, housekeepers, and receptionists remain exclusive employees on the payroll database of the Company. The Company maintains complete administrative control over salaries, statutory benefits, disciplinary actions, performance appraisals, and general career developments.

The Client shall not subject deployed personnel to direct disciplinary actions. Any performance discrepancies, misconduct, or operational complaints must be escalated immediately in writing to our designated Operations Coordinator for rapid corporate resolution.

Section 08

Termination Clause

Either party may terminate the active service agreement by serving a prior, written notice of **15 to 30 calendar days** (as agreed upon in the primary contract shell). Immediate termination is legally permitted in cases of severe statutory breach, physical hazard exposure, corporate insolvencies, or failure to clear due invoices after formal service holds are triggered.

Section 09

Liability & Damages

The Company operates in a service advisory and execution capacity and is not liable for indirect, consequential, or speculative commercial losses. Deployed staff are fully trained in high-end operations, but the ultimate security or sanitation of the facility is a joint responsibility.

Any concrete complaints regarding material loss, security bypass, or physical damage allegedly caused by deployed staff will undergo rigorous, joint fact-finding audits led by Recrutiz corporate risk inspectors. Resolution, compensation limits, and liability settlements will be strictly evaluated under standard corporate insurance policies.

Section 10

Confidentiality

Both parties agree to maintain absolute, legal confidentiality regarding trade secrets, facility maps, security codes, billing margins, operational guidelines, and corporate information acquired during the service duration. This NDA shell remains fully active during the active contract and extends indefinitely following the conclusion of services.

Section 11

Force Majeure

The Company shall not be held liable for failure, performance delay, or roster absence arising from circumstances beyond its reasonable control, including natural disasters, regional strikes, national lockouts, civil unrest, state emergency declarations, government restrictions, or extreme weather conditions.

Section 12

Legal Jurisdiction

All service agreements and operations governed by these Terms & Conditions are subject to state laws. In the event of a dispute, both parties first agree to engage in professional mediation. Unresolved disputes shall fall under the exclusive legal jurisdiction of the local courts of Noida, Uttar Pradesh, India.
